Eagle Lake city council hires defense

The Eagle Lake City Council approved to retain Scott Bounds of Olson and Olson to defend the city in the case of Richard Lyle Anderson, trustee et al, Dana Anderson and Robbie Gay Anderson versus the city of Eagle Lake at their regular meeting Tuesday, July 10.
The plaintiff, the Andersons, have accused the defendant, the city of Eagle Lake of inverse condemnation, trespass without valid easement on their land located in the city and declaratory judgment and filed an original petition for the suit at the Colorado County Courthouse Thursday, June 21.
An answer to the plaintiff's original petition was filed by the city of Eagle Lake July 13 at the courthouse stating that the city denies generally every allegation contained in the petition and demands strict proof by a preponderance of the credible evidence.
Under affirmative defenses it is stated that the city of Eagle Lake abandons the two inch water line and its related prescriptive easement that is the subject of the lawsuit.
City Manager Ronald Holland said Bounds specializes in municipal lawsuits and would a great selection in representing the city.
"We should go with him because he specializes in this field," Holland said. "This way we will get through it accordingly."
In other business, council discussed plans on the construction of restrooms and lights at E.H. Henry Park and scheduled a special meeting workshop for Thursday, July 19 to talk with a representative from LCRA about further information on the grants for the project.
Council discussed the matter about possibilities of where the lights and restrooms would be located and decided that plans need to be wrapped up by Sept. 1 regarding the grant to LCRA for the construction on the park.
Also, Holland informed council that he found out the morning of the meeting from the Internal Revenue Service that the city's volunteer firemen retirement fund is not subject to withholding.
After further discussion, council agreed that the city take money out to contribute to a retirement fund for the fireman and discontinue their discount for utilities.
"I talked with some of the fireman and nobody objected," Holland said.
Council also agreed to withhold the taxes for the discount for city employees and council members.
The next meeting is scheduled July 24.
