E-Cigarettes and Vaping Texas, including the Columbus Independent School District (ISD), has a strict policy regarding e-cigarettes and vaping in schools, primarily driven by a state law, House Bill 114. This legislation mandates disciplinary action for students caught with vaping devices on school property or at school-related events.
The policy includes prohibitions on the use and possession of e-cigarettes and tobacco products on school property and at school events. Under Texas House Bill 114, being caught vaping near school property or at a school-sponsored event can result in mandatory transfer to a Disciplinary Alternative Education Program (DAEP). If a DAEP is full, students may be placed in in-school suspension until space is available. The policy covers school premises and all school-sponsored or related activities, regardless of location. It also applies to students caught selling or under the influence of vape pens or e-cigarettes. Schools may offer tobacco education or cessation programs as part of the disciplinary process. Vape pens containing THC can lead to more severe penalties. In Texas, it is illegal for individuals under 21 to purchase, possess, or use tobacco or e-cigarette products, with exceptions for active military members. Violations can result in fines and other consequences.

E-Cigarettes and Vaping House Bill 6 from this most recent legislative session removed mandatory discipline alternative education program (DAEP) placement for first-time offenders of possession or use of a nicotine delivery product, or e-cigarette. School districts now have the option to instead suspend first-time offenders. Rice CISD’s code of conduct leaves discipline up to the discretion of a school administrator.
